For the purpose of this agreement, “BREEDER” shall refer to Austin & Kimberly, Long
Lake Frenchies, 6455 Lakeview Dr, Nine Mile Falls, WA 99026. “FRENCH BULLDOG”
shall refer to the dog identified above and “GUARDIAN” shall refer to the individual(s)
identified above. The following conditions apply:
1. The intent of this agreement is to provide ______________________________
(GUARDIAN) with a French Bulldog at no purchase price, in order for the
BREEDER to have the dog included in Long Lake Frenchie’s breeding program.
The GUARDIAN will pay a $1000 non refundable Guardian Fee.
2. Ownership of this dog, chip #________________________ remains the property
of the BREEDER until the FRENCH BULLDOG has had 3 litters. At this time the
ownership will transfer to the GUARDIAN and will be spayed at the GUARDIAN’S
expense.
3. The BREEDER guarantees that the FRENCH BULLDOG has been examined by
a veterinarian and found to be healthy.
4. The GUARDIAN will take possession on _______________________ with
responsibility to:
a. Safely confine dog with use of a fenced yard or leash.
b. Provide housebreaking by the age of 9 months. (potty training, etc) We
require that FRENCH BULLDOG be inside dogs.
c. Not over exercise the dog (including no excess running, jumping, or stairs
prior to the age of 24 months). Minor stairs in and out of home excluded.
d. Provide basic obedience training.
e. Feed the dog a quality balanced diet with quality dog food during the
duration of this contract.
f. Keep dog free from fleas or other parasites.
g. Contact the BREEDER immediately in the event of a serious illness,
accident, or death.
h. If required, license dog with the city and keep license current.
i. Maintain this contract even in the event that the GUARDIAN moves and will bring dog to breeder when requested.
j. Keep dog groomed (coat, claws, etc)
k. Keep dog well socialized with other dogs and people of all ages whenever possible.

5. This puppy is being placed under Guardianship and will not be spayed at the time of delivery. The following conditions apply to the Guardian portion of the agreement:

a. The GUARDIAN agrees to allow the puppy to have (3) litters for the BREEDER. The GUARDIAN and BREEDER can agree on a (4th) litter if mutually agreed upon. Once three (3) litters have been born the BREEDER shall have the FRENCH BULLDOG spayed at the GUARDIAN’S expense and full ownership rights shall be turned over to the GUARDIAN.
b. The GUARDIAN understands that the first breeding will take place after or about 1.25 to 1.75 years of age upon completion of appropriate genetic testing and that the FRENCH BULLDOG will only be bred with the approval of a qualified Veterinarian. The GUARDIAN family agrees to transport their dog to the BREEDER’S home for all breeding related visits.
c. The BREEDER shall be responsible for the cost of all health testing and all expenses related to breeding including veterinary fees and semen shipping costs.
d. The GUARDIAN is responsible for normal costs associated with pet ownership such as food, booster shots, regular veterinary exams, spay, etc. The GUARDIAN agrees to use the services of an approved Veterinarian for all vet care.
e. The GUARDIAN agrees to work with the BREEDER for all breeding arrangements. We ask Guardian homes to assist with occasional vet appointments related to breeding for things like conducting health clearances, checking progesterone levels, ultrasounds, etc (unless other arrangements are made). All costs associated with breeding (vet checks, appts, etc) are responsibility of BREEDER.
f. As a way of showing appreciation, the GUARDIAN will receive “financial compensation” (with a 1099 at year end) whenever their female is left with Long Lake Frenchies for births and whelping of puppies in the amount of $300 for the 1st breeding, $400 for the 2nd breeding, and $500 for the 3rd breeding. The Guardian dog must be in a Guardian home for over 6 months to qualify for their first financial compensation. In the event in which there are no living puppies there will be no financial compensation given.
g. The GUARDIAN is responsible for the costs of vet care arising out of negligence, lack of supervision, or general life events: poisoning, ingestion of foreign objects, skeletal trauma, viral illness, etc.
h. The GUARDIAN agrees to make the FRENCH BULLDOG available for health testing and breeding at the appropriate times, usually with several days notice, but on rare occasions, with as little as 12-24 hours notice.
i. The GUARDIAN is responsible for keeping the FRENCH BULLDOG adequately contained and supervised during heat cycles and to inform the BREEDER immediately upon the start of any (and every) heat cycle. If they so desire, the GUARDIAN may opt to have the FRENCH BULLDOG stay at the BREEDER’S home during heat cycles.
j. The BREEDER reserves the right to make all breeding decisions including choice of stud, method of breeding (which will always be invitro), and mid term ultrasounds or end of term x-rays. The final decision for all sales shall rest with the BREEDER.
k. The adult FRENCH BULLDOG shall be delivered to the BREEDER’S house one week before her due date and shall remain with the BREEDER until the pups are 6-8 weeks of age and then the FRENCH BULLDOG shall be returned to the GUARDIAN family. The GUARDIAN family shall be permitted to visit the FRENCH BULLDOG weekly during this period provided they take requested precautions to ensure the puppies safety. (If mutually agreed upon by BREEDER and GUARDIAN the puppies may be whelped by the GUARDIAN family.)
l. All puppies whelped shall be the sole property of the BREEDER and the GUARDIAN shall not be entitled to any financial interest or ownership of the puppies. If the GUARDIAN decides to adopt another puppy, the second puppy is half price if a pet and if applied and accepted into our Guardian Program the $1000 fee will be reduced to $500 (non refundable)
m. The BREEDER agrees that no puppies shall ever be sold to a pet store or a research lab.
n. If for some reason the FRENCH BULLDOG is unable to conceive for multiple cycles or does not pass health testing to BREEDERS satisfaction the GUARDIAN shall have the option of keeping it as a spayed family pet or returning it to the BREEDER.
o. Should the GUARDIAN breed the puppy at any time without permission or allow it to be bred unsupervised during a heat then the BREEDER shall 4 have the right to repossess the FRENCH BULLDOG and the agreement shall be null and void. Further all pups produced from such breeding shall be the sole property of the BREEDER.
p. The GUARDIAN shall inform the BREEDER in advance of taking any extended trips (over 7 days duration) with the FRENCH BULLDOG. Should the timing of a vacation fall during a time when a heat is anticipated the GUARDIAN shall bring the FRENCH BULLDOG to board with the BREEDER at no cost for the duration of the the GUARDIANS absence.
q. The GUARDIAN shall maintain the FRENCH BULLDOG at a proper weight at all times. Failure to maintain a reasonable weight (as determined by a veterinarian) shall null and void this agreement and the BREEDER shall have the right to repossess the FRENCH BULLDOG. In such an event every opportunity shall and will be given the GUARDIAN to correct the weight problem, as well as a veterinary diet, if necessary.
r. The GUARDIAN agrees to follow the BREEDER’S directions for feeding during pregnancy or after weaning. If additional supplements are required they will be provided at the BREEDER’S expense.
s. The GUARDIAN agrees to work with the BREEDER on all travel arrangements for both breeding and the whelping of puppies. The GUARDIAN assumes full responsibility for transporting the female to the BREEDER’S home. (Through mutual agreement BREEDER and GUARDIAN may agree on a meeting place to pick up/drop off FRENCH BULLDOG)
t. Should the dog die, get stolen, or lost due to NEGLIGENCE on the part of the GUARDIAN, the GUARDIAN agrees to pay a replacement fee of $3000. Should the dog die, get stolen, or lost in the BREEDER’S care this agreement shall terminate, and the BREEDER will provide the GUARDIAN with a replacement puppy from the next available litter or refund the initial $1000 guardian adoption fee.
u. Should the GUARDIAN have the puppy spayed without the express written permission of the BREEDER, damages payable in the amount of $9,000 plus legal fees shall be payable to the BREEDER and physical possession shall be returned to the BREEDER immediately.
v. Should the GUARDIAN decide not to partake in the breeding program, minimum three (3) litters, it shall be grounds for the BREEDER to repossess the FRENCH BULLDOG, or at the BREEDER’S discretion, the GUARDIAN shall pay a $5,000 penalty if the FRENCH BULLDOG is younger than six (6) months and $9,000 penalty if the FRENCH BULLDOG is older than six (6) months.
w. Should the GUARDIAN move away from the area (more that 300 miles from the BREEDER’S residence) at any time prior to the completion of the three (3) breedings, the BREEDER will have the right to keep the FRENCH BULLDOG at their residence until the time of all breedings is complete. Then the FRENCH BULLDOG will be returned to the GUARDIAN home with transport/shipping costs being split by the BREEDER and GUARDIAN.
x. Non Assignment: Except as otherwise expressly provided under this Agreement, neither this Agreement nor any right or obligation hereunder may be assigned or otherwise transferred (whether voluntary, by operation of law or otherwise), without the prior express written consent of the parties.
y. This agreement shall be interpreted, construed, and enforced in accordance with, and the rights of parties shall be governed by, the laws of the State of Washington, excluding its choice of law rules.
z. This agreement constitutes the entire agreement among the parties with regard to the subject matter hereof.
This Agreement supersedes all other agreements, representations, or understandings (whether oral or written and whether express or implied) relating to the subject matter hereof. No provision of this Agreements may be waived, changed, terminated, modified, or discharged, orally or otherwise except by a writing signed by the party against whom the waiver, change, termination, modification, or discharge is sought to be enforced. Arbitration: In the event of a dispute under this Agreement, the parties will negotiate in good faith to resolve such dispute. If a resolution is not reached among the parties within 45 days after written notice of a dispute, the dispute shall be finally settled by binding arbitration in Spokane, Washington. Such arbitration shall be conducted in accordance with the rules of the American Arbitration Association by one (1) arbitrator appointed in accordance with such rules. The arbitrator shall allow such discovery as is appropriate to the purposed of arbitration in accomplishing a fair, speedy, and costeffective resolution of the dispute. The award of arbitration shall be final and binding upon both parties. The arbitrator will award to the prevailing party all costs, fees, and expenses related to the arbitration, including reasonable fees and expenses of attorneys incurred by the prevailing party, and judgement on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof. 6 I have read the above terms and conditions and agree to be bound by them.
