This agreement between the Buyer(s) __________________________________________________________ and the Seller(s)

______________________________________________________________________ shall be in effect for one (1) year from todays date of _______________________________________________________ . Long Lake Frenchies guarantees that the French Bulldog Puppy is purebred and can be AKC registered no later than 6 months after DOB (IF FRENCHTON, THEY ARE NOT "PUREBRED" AND CANNOT BE AKC REGISTERED AS THEY ARE NOT RECOGNIZED BY THE ORGANIZATION. The rest of the Health Guarantee Pertains to Frenchtons as well as purebred French Bulldogs.

The Seller guarantees that the Puppy does not have any incurable and debilitating genetic disorder requiring the dog to be euthanized. Seller cannot guarantee the adult size, color, hair coat, temperament, or trainability of a puppy. Puppies’ eyes are blue, but they turn usually gray/brown. The guarantee does not cover the following, which are common conditions for the bulldog breed and highly unpredictable: treatment for internal or external parasites or bacteria, cherry eye, loose hips, loose knees, skin allergies, elongated soft palates, and small or collapsed (stenotic) nostrils, bad or uneven bites, demodex, mange, entropion, backbone problems, inguinal or umbilical hernias, coccidia, kennel cough, giardia, kyphosis, hypoplastic trachea or thyroid dysfunction, retained testicles.
Cancer can be caused by many things which are out of our control so it is not covered by the health guarantee. The Seller does not guarantee against any diseases that can be acquired after the Puppy has left the Seller's possession. No guarantees apply to health-related problems caused by nutrition or care, nor any accident or illness. Buyer agrees to maintain this Puppy in lifelong good condition with annual veterinary checkups, timely vaccinations, proper diet, and hygienic conditions, especially by the following: giving Bravecto or Advocate drops to prevent skin issues as needed. 

As a responsible owner, the new owner agrees to feed the Puppy with premium dog food and not allow the Puppy to become obese.  (See last paragraph of Health Guarantee and initial)  Buyer agrees if at any time Buyer can no longer care for the Puppy the Seller shall be notified and given the right of first refusal to Long Lake Frenchies. Seller will assist in the placement of this Puppy or the Seller may take the Puppy back. Buyer agrees that under no circumstances, and at any time, will this Puppy be sold, leased, or given, to anyone or to any pet shop, shelter, or research facility. The buyer acknowledges and accepts that there is no other health guarantee other than the ones stated herein. 
The guarantee is not meant to warrant that the Puppy will not have a health problem in his or her entire life. A Puppy's health depends on many different factors such as proper feeding, care, exercise, and genetics.   Some of these issues are unpredictable or the Seller has no influence on them. In spite of our experience, strict protocols, and loving care, no one can guarantee that the dog will not have a health issue at some stage of its life. Based on the Seller’s guarantee, the Buyer is entitled to claim replacement only and shall in no case be entitled to claim the reimbursement of the Purchase Price in whole or part or any reimbursement of veterinary/medical expenses incurred by the Buyer or any other expenses in whole or part.
Due to the inherent variability of breeding and the litters, it may happen that a similar Puppy is not available immediately but in a reasonable period of time, not to exceed one year. In the event no such Puppy is available or the Seller is no longer breeding, a refund of one-half the Purchase Price will be given to the Buyer within 60 days of the event. Any noticed health issue shall be reported immediately (before the first visit of your veterinarian) to the Seller by phone at (208) 290-8072 or by email at LongLakeFrenchies@gmail.com to allow for assistance and advice before vet visit, unless in case of an emergency.

Not reporting a serious health issue within 24 hours after the first veterinary visit, an emergency vet visit, or any decision to euthanize will result in the cancellation of the guarantee. The official report - written up with the clinic’s official headed paper and signed by the veterinarian - including the dog’s date of birth, registered name/number, and microchip number shall be scanned and emailed to LongLakeFrenchies@gmail.com within 24 hours after the examination. The report must be clear and precise stating the symptoms, exact problem, severity, and the test(s)/examinations that have been done, i.e.: x-ray, ultrasound, blood test. A second official licensed veterinarian’s report from another independent clinic may also be required depending upon diagnosis. Any and all veterinary records must be forwarded to the Seller upon request. Clear digital photos and/or video may also be requested to verify a problem. Before any claim is granted the Seller’s licensed veterinarian or a specialist will have to view the prepared reports of the veterinarian(s) and approve the validity of the claim. Should the dog die due to a genetic disorder within the first year from the date of purchase, the Seller will replace the Puppy for the Buyer provided the Seller is given substantiating documentation and evidence on the genetic disorder. The Buyer agrees to have a necropsy performed at the Buyer's expense by a licensed veterinary pathologist with appropriate tissue samples taken and evaluated and a copy of a written report of this has to be sent to the Seller for review.
The Seller will pay no veterinary expenses. No reimbursements of any money for veterinary bills incurred will be provided by the Seller. These are solely the responsibility and cost of the Buyer.

Other Provisions
This Contract is concluded in an electronic format and typed paper hard copy thus the conclusion of the Contract is evidenced exclusively by the date given upon ordering the Puppy. For the conclusion of the Contract, the Buyer must accept the provisions of this Contract by an explicit declaration by which the Buyer also acknowledges that the Seller has made the Contract available to him/her in its entirety before possession of the puppy is transferred to the buyer. Violation of any provision of this Contract may result in the Seller reclaiming the Puppy without a refund.
Should any provision of this Contract be invalid or nonenforceable, this shall not affect the validity of the other provisions of this Contract. All difficulties relating to the interpretation, execution, or expiry of these commitments shall, in the absence of agreement, be submitted to an Arbitrator.
In the event of a dispute under this Agreement, the parties will negotiate in good faith to resolve such dispute.  If a resolution is not reached among the parties within 45 days after written notice of a dispute, the dispute shall be finally settled by binding arbitration in Spokane, WA. Such arbitration shall be conducted in accordance with the rules of the American Arbitration Association by one (1) arbitrator appointed in accordance with such rules. The arbitrator shall allow such discovery as is appropriate to the purpose of arbitration in accomplishing a fair, speedy, and cost effective resolution of the dispute. The award of arbitration shall be final and binding upon both parties. The arbitrator will award to the prevailing party all costs, fees, and expenses related to the arbitration, including reasonable fees and expenses of attorneys incurred by the prevailing party, and judgement on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.

 

In order for this Health Guarantee to remain valid for one (1) year, the French Bulldog/ Frenchton must remain on a Lifes Abundance nutrition plan. When food is purchased through www.lifesabundance.com/longlakefrenchies, you'll be given an electronic receipt for your records that is also bookmarked for Long Lake Frenchies reference if an issue were to arise.    Initial(s) _________
